Customer/Contractor shall locate, mark, expose and/or protect all facilities that are not part of the One Call locate System (811), including Customer owned facilities. This includes all public and private, mechanical or electrical facilities. Failure to locate, mark, expose and/or protect such facilities is owned exclusively by the Customer/Contractor and shall assume full responsibility for any damages, delays, expenses, or additional costs incurred by NIPSCO. Additionally, the Customer/Contractor shall indemnify and hold harmless NIPSCO from any claims, liabilities, damages, expenses or any costs whatsoever arising out of this failure, and shall promptly reimburse NIPSCO for any expenditures necessary to remedy and/or mitigate this failure.
